These Terms & Conditions ("Terms") govern your use of kinemationmedia.com and the products and subscriptions offered by Kinemation Multimedia, LLC ("Kinemation", "we", "us"), including Kinemation WellStream™, Kinemation Visual Intelligence™ and Kinemation Visual Gallery™ (together, the "Service"). When you use the Service, you are contracting with Kinemation Multimedia, LLC.

1. Acceptance

By accessing or continuing to use the Service, you agree to these Terms. If you use the Service on behalf of a practice or business, you confirm you have authority to bind it. If you do not agree, do not use the Service.

2. The Service

Kinemation provides digital clinical education content for chiropractic and healthcare practices, delivered as business-to-business software subscriptions, including reception-area streaming presentations and interactive education modules. Kinemation Multimedia, LLC does not sell, manufacture or distribute any physical products, medications, supplements or peptides; any health topics in the Service are presented solely as patient education. The Service is educational and does not replace professional clinical judgment.

3. Accounts

You must provide accurate information, keep it up to date, and keep your sign-in credentials confidential. You are responsible for activity under your account.

4. Licence and acceptable use

We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You must not misuse the Service, including:

• using it for any unlawful purpose or in violation of any law;
• fraud, spam or misleading activity;
• infringing our or anyone else's intellectual property;
• interfering with security — introducing malware, probing or testing vulnerabilities, or scraping;
• reverse engineering, reselling or redistributing the Service, or circumventing plan or screen limits.

5. Intellectual property

Kinemation Multimedia, LLC retains all ownership of the Service and its intellectual property, including software, animations, illustrations, documentation and branding. Content you add (such as your practice name, logo or announcements) remains yours; you grant us a limited licence to host and display it solely to provide the Service.

6. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms. Subscriptions renew monthly until cancelled; cancelled subscriptions remain active through the end of the paid period. See our Refund Policy.

7. Service level

We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. The Service depends on your own television, streaming device and internet connection.

8. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your reception screens stop playing; we keep your settings for a reasonable period so you can renew, after which they may be deleted.

9. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including lost profits or data. Our total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it.

10. General

These Terms are governed by the laws of the Commonwealth of Pennsylvania. You may not assign these Terms without our consent. We are not responsible for delays caused by events beyond our reasonable control. We may update these Terms and will post the new date above.
